1. IS THE NEC OPERATIONAL DURING LOCKDOWN?

Yes the NEC is operational, the offices are closed but we are embracing the new normal by working from home, all services can be provided virtually.

2. CAN COLLECTIVE BARGAINING BE DONE DURING LOCKDOWN?

Yes it can be done, virtual meetings can be done, because of technology, lockdown cannot cripple any form of negotiations. Virtual negotiations can be done and concluded then relevant parties can sign the agreed documents online.

3. CAN I REPORT MY CASE OR COMPLAINT DURING LOCKDOWN?

4. CAN INSPECTIONS BE DONE DURING LOCKDOWN?

No they can’t be conducted during lockdown, due to the need to protect everyone since it is very risky for everyone, but if there are any important issues which require the attention of the DA, feel free to request an IN – LOCKO (which can be provided specifically for serious emergency investigation only).

5. ARE EMPLOYEES ENTITLED TO THEIR WAGES DURING LOCKDOWN?

Yes they are entitled to their normal salaries and wages, if there are any mitigatory measures to be implemented they must be done within the confinements of the law, lockdown is not an excuse to break the law you will be found wanting. As long as a contract of employment still subsists, an employer should pay employees full wages during lockdown.

6. HOW AM I SUPPOSED TO GET AUTHORITY TO TRAVEL TO WORK?

All employers requiring their employees to work, must provide them with letters indicating so, the letter must have full details of the employee including their workstation location, the documents must be stamped and signed. Further authentication of travelling documents can be done at the nearest police station.
